South Dakota Air Permits

South Dakota DANR's Air Quality Program issues minor source operating permits (ARSD 74:36:04), Title V (Part 70) operating permits, general permits for portable and stationary sources (asphalt plants, rock crushers, concrete plants, grain elevators), and PSD pre-construction permits (ARSD 74:36:09, adopting 40 CFR 52.21). South Dakota is in attainment, so nonattainment NSR (ARSD 74:36:10) does not currently apply. The Rapid City area has PM10 Natural Events Action Plan requirements, including general permits for construction and continuous activities on state property. EPA Region 8 is the permitting authority in Indian Country.

Air permits & authorizations

  • Insignificant activities

    Exemption

DANR provides an Insignificant Activities data sheet to be submitted with applications. DANR's permitting page does not list facility-level exemptions.

  • General Permits

Requires an application and a Notice of Intent to operate. Flat annual fees apply to asphalt plant and rock crusher general permits.

  • Construction Permit

    Minor NSR

DANR provides a general construction permit application form. DANR's permitting page describes pre-construction permits mainly in the PSD context.

  • Minor Source Operating Permit

    State Operating

For sources that are not Part 70 sources and are below the uncontrolled potential emission level for Part 70.

Thresholds (summarized from source, not a quotation)

Uncontrolled potential emissions below 100 tons per year of a regulated pollutant (restated from DANR).

Major NSR (PSD & nonattainment)

  • Prevention of Significant Deterioration (PSD) pre-construction permit

    Nonattainment NSR

Applies only in areas designated nonattainment; DANR states South Dakota is in attainment, so it does not currently apply.

Title V operating permits

  • Title V (Part 70) Operating Permit

    Title V

For major sources, and sources that fall under NSPS or MACT applicability requirements. Fees under ARSD 74:37 (administrative fee by emission tier plus a per-ton emission fee).

Thresholds (summarized from source, not a quotation)

Potential to emit greater than 100 tons per year of a regulated pollutant, more than 10 tons per year of one HAP, or more than 25 tons per year of combined HAPs (DANR quotes 'greater than 100 tons per year').

Oil & Gas

DANR's air permitting and application pages list no oil and gas specific air permits. Oil and gas sources follow the minor source and Title V thresholds and applicable federal NSPS/NESHAP (adopted by reference in ARSD 74:36:07 and 74:36:08). Oil and gas wells on tribal lands fall under EPA Region 8.
