New Mexico Air Permits

NMED's Air Quality Bureau regulates stationary sources statewide except Albuquerque/Bernalillo County. Depending on emissions, a source may need no permit, a Notice of Intent (20.2.73 NMAC), a minor source construction permit or general construction permit (20.2.72 NMAC), a PSD permit (20.2.74 NMAC), a nonattainment permit (20.2.79 NMAC), and/or a Title V operating permit (20.2.70 NMAC). Most applications use the Universal Application Form and the AQB ePermitting Portal.

Air permits & authorizations

  • No permit required

    Exemption

Sources below the listed thresholds need no permit; the operator should maintain records of the calculations. Potential emission rate and potential to emit are defined in 20.2.73 NMAC.

Quoted verbatim from the agency source
Less than 10 tons per year of any regulated air contaminant (includes volatile organic compounds (VOCs)), Less than 10 pounds per hour of any regulated air pollutant with a national or state ambient air quality standard (does not include VOCs), and Less than 1 ton per year of lead.

  • Notice of Intent (NOI)

    Registration / Notice

A filing with NMED before construction. Per NMED, an NOI is not a permit. A separate Oil and Gas NOI form exists.

Quoted verbatim from the agency source
More than 10 tons per year for any regulated air contaminant (including VOCs).

  • Minor Source Construction Permit (Part 72)

    Minor NSR

Required before construction or modification above the Part 72 triggers. Includes streamline permits (20.2.72.300 NMAC) and toxic air pollutant review (20.2.72.400 NMAC).

Quoted verbatim from the agency source
More than 10 pounds per hour of criteria pollutants (does not include VOCs), More than 25 tons per year of criteria pollutants (does not include VOCs), or More than the pound per hour levels listed in 20.2.72.400 NMAC for New Mexico Toxic Air Pollutants.

  • General Construction Permits (GCPs)

    General Permit

Pre-written construction permits for specific source categories: Oil and Gas Facilities (GCP-O&G), Quarrying/Crushing/Screening (GCP-2), Hot Mix Asphalt (GCP-3), Concrete Batch Plants (GCP-5), Oil and Gas Storage Vessels (GCP-6), and Temporary Control Facilities (GCP-TC).

Major NSR (PSD & nonattainment)

  • Prevention of Significant Deterioration (PSD) Construction Permit

    PSD

Major source construction permit for attainment areas.

Quoted verbatim from the agency source
A stationary source is listed in Table 1 (20.2.74.501 NMAC) which emits, or has the potential to emit, 100 tons per year or more of any regulated new source review pollutant. Any stationary source not listed in Table 1 (20.2.74.501 NMAC): 250 tons per year or more of any regulated new source review pollutant.

Title V operating permits

  • Title V Operating Permit

    Title V

Operating permit for major sources. Except for certain grandfathered sources, Title V sources must also obtain a construction permit before constructing or modifying. First-time applications are due within 12 months after the source begins operating as a Title V source.

Quoted verbatim from the agency source
Facilities with the potential to emit more than 100 tons per year for any pollutant subject to regulation (includes VOCs), Landfills greater than 2.5 million cubic meters in volume, or Facilities with the potential to emit greater than 10 tons per year of a single Hazardous Air Pollutant, or 25 tons per year of any combination of Hazardous Air Pollutants.

Oil & Gas

New Mexico has oil and gas specific NOI forms and general construction permits, plus the Oil and Gas Sector Ozone Precursor Pollutants rule (20.2.50 NMAC), which sets emission control requirements for oil and gas equipment in affected areas.
