Oregon Air Permits

Oregon DEQ issues Air Contaminant Discharge Permits (ACDPs) for minor sources and for new major sources/major modifications, plus Title V operating permits for major sources. Which ACDP applies depends on the source category in the Table of Activities and Sources (OAR 340-216-8010, Table 1): Part A sources qualify for a Basic ACDP, Part B for a General, Simple, or Standard ACDP, and Part C must get a Standard ACDP. Permits carry Plant Site Emission Limits (PSELs) compared against Significant Emission Rates (SERs). Many sources need a Notice of Construction even without a permit (OAR Division 210), and every permit needs a Land Use Compatibility Statement. Cleaner Air Oregon adds facility risk assessment for toxic air contaminants. LRAPA permits in Lane County; EPA Region 10 permits in Indian Country and on the Outer Continental Shelf.

Air permits & authorizations

  • Notice of Construction / Notice of Intent to Construct

    Registration / Notice

Many sources must submit a Notice of Construction even if no permit is required; sources that believe no permit is needed submit an AQ104 Notice of Intent to Construct.

    OAR 340 Division 210Official page
  • Basic ACDP

    Minor NSR

Contains only the most significant rules for listed Part A source categories; no PSEL; term up to 10 years. Categories: autobody shops (Portland area), concrete manufacturing, crematories, gas-fired boilers, prepared feeds, rock crushers, surface coating, and other sources taking enforceable limits.

Thresholds (summarized from source, not a quotation)

Typical actual emissions under 10 tons/yr (DEQ ACDP application instructions comparison table).

  • General ACDPs

    General Permit

Issued by order for a source category, up to 10 years; sources are assigned if they qualify and actual emissions stay below the General ACDP PSELs. Categories include degreasers (GP 05), dry cleaners (06), asphalt plants (07), rock crushers (08), concrete (09), sawmills (10), boilers (11), crematories (12), grain elevators (13), prepared feeds (14), seed cleaning (15), coffee roasters (16), bulk gasoline plants (17), electric power generators (18), clay ceramics (19), hospital sterilizers (20), gasoline dispensing (22, 23), metal fabrication/finishing (25, 29), plating and polishing (26), surface coating (27), air curtain incinerators (31), and emergency engines (Attachment 32a).

  • Simple ACDP

    Minor NSR

For Part B sources with source-specific PSELs below the SERs; term up to 10 years. A source may request a Standard ACDP instead to keep a netting basis.

  • Standard ACDP

    Minor NSR

For Part C sources, sources requesting a PSEL at or above the SER, sources keeping a netting basis, and sources meeting potential-to-emit criteria; term up to 5 years. Also used for NSR/PSD sources.

  • Construction ACDP

    Other

Covers Type 3 or Type 4 construction or modification changes (OAR 340-210-0225) for sources needing a Standard ACDP or Title V permit. Optional for ACDP sources, required for Title V sources. Does not authorize operation.

Major NSR (PSD & nonattainment)

  • Major New Source Review (PSD and nonattainment/maintenance area NSR)

    PSD

New major sources and major modifications obtain a Standard ACDP (DEQ lists a separate initial fee for NSR/PSD Standard ACDPs). Oregon's major NSR rules are in OAR Division 224.

Title V operating permits

  • Oregon Title V Operating Permit

    Title V

For major sources; about 120 sources are permitted. Sources can take federally enforceable limits to remain synthetic minors in the ACDP program. Funded by emission, base, and user fees (OAR Division 220).

Thresholds (summarized from source, not a quotation)

Potential to emit 100 tons of any criteria pollutant, 10 tons of any single HAP, or 25 tons of any combination of HAPs (restated from DEQ's Title V Rules and Fees page).

Oil & Gas

Oregon has no oil production; DEQ's General and Basic ACDP lists include no oil and gas production permits. Related categories are bulk gasoline plants (GP 17), gasoline dispensing (GP 22/23), and gas-fired boilers (Basic 04, GP 11).
