Mississippi Air Permits

Mississippi requires a Permit to Construct for new facilities unless a facility-wide exclusion under Rule 2.13 applies. Construction permits are PSD (major), PSD-avoidance (moderate sources taking limits), or minor. Operating permits are Title V (Chapter 6), Synthetic Minor Operating Permits, or State Operating Permits for listed significant minor source types; true minor sources need no operating permit. MDEQ charges no air permit application fees; only Title V facilities pay annual fees.

Air permits & authorizations

  • Permit to Construct exclusions

    Exemption

Facility-wide exclusions under Rule 2.13.D and 2.13.E. The common Rule 2.13.D(5) exclusion does not apply to facilities with hazardous or solid waste incinerators or to CAFOs.

Thresholds (summarized from source, not a quotation)

Per MDEQ (Rule 2.13.D(5)): facility-wide potential emissions below 10 tpy each of PM10, SO2, NOx, CO, and VOC; below 1.0 tpy any single HAP; below 2.5 tpy total HAPs.

  • General Permits

    General Permit

MDEQ lists an Oil Production General Permit under air general permits, and multimedia general permits such as the Hot-Mix Asphalt General Permit.

  • Permit to Construct (minor and PSD-avoidance)

    Minor NSR

Minor sources below PSD thresholds without limits need a Permit to Construct unless excluded; moderate sources take federally enforceable limits through a PSD-Avoidance Permit to Construct. De minimis modifications (below 3/4 of significance or major thresholds) have a simplified path. Pre-permit construction at the applicant's risk is available for some projects (Rule 2.15.B).

  • Synthetic Minor Operating Permit (SMOP) and State Operating Permit

    State Operating

SMOPs set federally enforceable limits to avoid Title V. State Operating Permits are required for listed significant minor source types (e.g., cotton gins, rendering plants) under Rule 2.1.C(25).

Major NSR (PSD & nonattainment)

  • PSD Permit to Construct

    PSD

Adopts 40 CFR 52.21 with some exceptions. MDEQ estimates 150+ days.

Title V operating permits

  • Title V Operating Permit (TVOP)

    Title V

For major sources; revisions are administrative amendments, minor or significant modifications, or 502(b)(10) changes. Optional Title V modification path under Rule 2.15.C.

Thresholds (summarized from source, not a quotation)

Per MDEQ: potential emissions above 100 tpy of a criteria pollutant, 10 tpy of any single HAP, or 25 tpy of total HAPs.
