Louisiana Air Permits

In Louisiana any source that emits or could emit an air contaminant generally needs an air permit unless an exception applies. Very small facilities are excused by statute (Act 547) or can use the small source exemption (LAC 33:III.501.B.4); insignificant activities are listed in LAC 33:III.501.B.5. Other non-Part 70 facilities get state minor source permits under LAC 33:III.503, or coverage under minor source general permits such as the one for crude oil and natural gas production. Major sources need Part 70 (Title V) permits under LAC 33:III.507, plus PSD or nonattainment NSR for major projects.

Partially verified. Specific PSD and nonattainment section numbers and Title V thresholds were not stated on the LDEQ pages reviewed. The LAC 33:III Part III PDF is the copy posted on LDEQ's site; check for later amendments. Chapter 2 and 51 titles are summarized.

Air permits & authorizations

  • No permit required (Act 547 / R.S. 30:2054(B)(2)(b)(ix))

    Exemption

Facilities with facility-wide potential emissions below the limits generally need no permit; before exceeding them, apply for a permit or small source exemption. Portable source emissions count totals from all sites.

Thresholds (summarized from source, not a quotation)

Per LDEQ: below 5 TPY of each regulated pollutant, below 15 TPY combined, and below the minimum emission rate (MER) for each toxic air pollutant.

  • Small Source Exemption

    Exemption

For non-major sources with low emissions of regulated pollutants and toxic air pollutants below the MER (LAC 33:III.5112, Table 51.1), needing no enforceable permit conditions and no public notice.

Thresholds (summarized from source, not a quotation)

No more than 5 TPY of any regulated pollutant and less than the MER for each toxic air pollutant (restated from LDEQ).

Oil & Gas

Louisiana has a minor source general permit for crude oil and natural gas production facilities (SIC 1311) and midstream gas compression and processing (SIC 1389), with lower facility-wide limits in the five-parish Baton Rouge area. Part 70 sources and some others are excluded.

  • Minor Source General Permit: Crude Oil and Natural Gas Production Facilities

    General Permit

Covers field production and midstream compression/processing below facility-wide limits. Excludes Part 70 sources and facilities subject to LAC 33:III Chapter 59 or 40 CFR Part 68, among others.

Thresholds (summarized from source, not a quotation)

Per LDEQ general permit (facility-wide PTE, tpy): Baton Rouge area (Ascension, East Baton Rouge, Iberville, Livingston, West Baton Rouge): PM10 15, SO2 40, NOx 20, CO 90, VOC 20, total TAPs 20, individual TAP 8. Other parishes: same except NOx 90 and VOC 90.
